Beeching & Co. – Garden Design & Implementation - Terms and Conditions

The following conditions state the obligations, rights and responsibilities of all parties involved in this Agreement. The words “you” or “your” appear in reference to the Customer; “we”, “us” and “our” refer to Beeching & Co; “providers” and “teams” refer to the subcontractors who complete our gardening services. These Terms and Conditions can be changed, altered or amended subject to prior written notice. Please ensure you have read and understood our cancellation policy, outlined in Clause 5 of these Terms and Conditions. 1. Introduction

1.1 By accepting the quotation, paying the deposits required and the contract starting you are deemed to have accepted all the terms and conditions listed below along with the scope of works supplied.

2. Bookings and Confirmation

2.1 All work undertaken will be discussed and agreed prior to the start date and all work will be completed from the original design by Beeching & Co unless otherwise agreed.

2.2 The estimate/original price for work includes all materials and labour where stated from original design.

2.3 The customers shall provide water and electricity, if needed, at no charge to Beeching & Co.

2.4 The customer shall provide access to site and storage space for materials at all times during the works progress and Beeching & Co’s working hours. Our working hours are typically 0900 – 1700.

3. Pricing and Payment

3.1 The prices payable for the Services shall be those set out in the quotation. Extra work undertaken over and above the main contract will incur further costs.

3.2 Prices are open to acceptance up to three months from the date of the quotation.

3.3 Payment Terms – Designs:

3.3.1 Design value up to £1000 30% deposit, balance on presentation of final drawings and plans.

3.3.2 Design value £1001 and above 50% deposit, balance on presentation of final drawings and plans.

3.4 Payment Terms – Implementation of Design:

3.4.1 Contract value up to £1000 full payment on completion.

3.4.2 Contract value £1001 to £4999 30% deposit, balance on completion.

3.4.3 Contract value £5000 and above as per payment schedule supplied.

3.5 All VAT will be payable at the current rate of invoice issue date.

3.6 We understand and will exercise our right to claim interest at 3% and compensation for debt recovery costs under the late payment legislation if we are not paid according to the agreed credit terms. Payment methods are BACS (Internet bank transfer) or Direct Debit.

3.7 Title and ownership of the materials and equipment will not pass until final payment is made. Beeching & Co can recover any materials in the event of non-payment. The customer agrees to allow access to the site for this purpose.

4. Services

4.1 Severe weather conditions, including drought, may cause the delay of the start date/works of the contract. This will not affect the original, agreed price.

4.2 Delays caused by other companies on site may cause work to be rescheduled and charges may be made in certain circumstances.

4.3 All materials surplus to the work will remain the property of Beeching & Co and will be removed from site on completion. If the customer would like to keep any surplus materials then a charge will apply for them.

4.4 Maintenance and watering, unless specified, will become the responsibility of the customer and Beeching & Co cannot accept any responsibility for the well being and survival of living plant material, including turf, once the contract has been completed.

4.5 After completion, we are not able to accept responsibility for any damage through the elements, including drought, winds, rain and frost to any material(s) including plants.

4.6 Should any plant be unavailable we reserve the right to negotiate substitutes with the customer.

5. Cancellation

5.1 Cancellation of work not received within 5 working days of scheduled start of work will be subject to a charge of 15% of the quoted price. If the original price included a materials payment, this amount will be non-refundable, as materials would have already been purchased.

5.2 We will be entitled to suspend performance of, or terminate the contract if the customer fails to pay any sum due to us, in accordance with the payment terms, or is in breach of these terms, or becomes bankrupt, in which case we shall be entitled to payment for all the work carried out and for all goods supplied to the date of the termination or suspension of the contract, and to retain any deposit or interim payment made towards this.

6. Copyright

6.1 Any designs produced by Beeching & Co. cannot be reproduced or shared, without prior written consent by Beeching & Co. Once payment is received from you, you may then approach other contractors to quote for the project.

6.2 We reserve the right to use any drawings, photographs or plans undertaken by us for any future publications or displays whilst ensuring the anonymity of the respective customer.

7. Liability

7.1 Beeching & Co shall bear no liability for any damage to (or cost involved with) any underground hazards, obstructions or services not made known to us in writing or apparent on visual inspection.

7.2 We shall not be liable for any defects arising from the customer’s own actions or lack of care, including without limitation, inadequate watering, deliberate damage, removal or other abuse or damage caused by the customer.
